PRIVACY POLICY & PAIA MANUAL

PART 1: PRIVACY POLICY (POPIA)

This section describes how we collect, use, and protect your personal information in terms of the Protection of Personal Information Act 4 of 2013.

1. Information We Collect

We collect information you provide directly to us when you make a purchase, sign up for our newsletter, or contact support. This includes:

  • Identity & Contact Data: Name, email address, shipping address, and phone number.

  • Financial Data: Payment information (processed securely via third-party gateways; we do not store your credit card details).

  • Special Personal Information: As a health supplement provider, any health goals or dietary requirements you provide are treated as sensitive data and processed only with your explicit consent.

  • Technical Data: IP address and browser type via cookies to improve your shopping experience.

2. Purpose of Processing

We use your data to:

  • Process and deliver your orders and manage returns under the ECTA.

  • Communicate updates regarding your purchase.

  • Send marketing materials (only if you have opted in).

  • Comply with South African tax (VAT) and legal record-keeping obligations.

3. Data Storage, Security & Trans-border Transfers

Your data is stored securely on Shopify’s servers. As Shopify is a global platform, your information will be transferred and stored outside of South Africa. In accordance with Section 72 of POPIA, we ensure that our service providers adhere to strict data security standards (such as GDPR or equivalent) that provide an adequate level of protection.

4. Your Rights

Under POPIA, you have the right to:

  • Request access to the personal information we hold about you.

  • Request the correction or deletion of your personal information (subject to statutory retention periods, e.g.: SARS requirements).

  • Object to the processing of your data for direct marketing.

PART 2: PAIA MANUAL (ACCESS TO INFORMATION)

This section is prepared in terms of Section 51 of the Promotion of Access to Information Act 2 of 2000 (“PAIA”).

2. The PAIA Guide

The Information Regulator has, in terms of section 10(1) of PAIA, made available a Guide on how to use PAIA. This is available at www.inforegulator.org.za.

3. Records Held in Accordance with Other Legislation

We maintain records as required by the following (among others):

  • Companies Act 71 of 2008.

  • Value Added Tax Act 89 of 1991.

  • Electronic Communications and Transactions Act 25 of 2002.

  • Consumer Protection Act 68 of 2008.

4. Description of Records Held (Formal Request Required)

We hold the following categories of records which require a formal request via Form 2:

  • Financial Records: Annual financial statements, tax records, and asset registers.

  • Commercial Records: Supplier agreements, logistics contracts, and product formulations/COAs.

  • Customer Records: Transaction history and health-related consultation data.

5. Procedure to Request Access

To exercise your right to access information under PAIA:

  1. Form: Complete Form 2 (available on the Information Regulator’s website).

  2. Submission: Email the form to the Information Officer at the address above.

  3. Fees: A request fee of R140.00 must be paid before we process the request.

  4. Outcome: We will notify you of our decision within 30 days.
